The FFL retailer, where you are at completing transfer, is the seller. GunsExpress acted as the salesman for the FFL retailer.

I've changed my mind, can I return the gun I just bought?

No. All sales are final this is the official policy. But, in some cases, you may be allowed to return the guns, provided the suppler agrees to accept it back and you pay GunsExpress the return shipping cost and a cancellation fee of 15% of the gun or $50, which ever is greater.

If there is a defect in the gun, can I return/exchange the gun?

Defects are handled directly by the manufacturer and based on their respective policies. GunsExpress and the FFL retailer are not responsible for defects in the guns sold. Returns and exchanges can only be authorized by the manufacturer.

Terms of sale are no refunds and guns are sold as-is. Disputing the charge to force a return will not be successful.

Do I have to pass a background check with the GunsExpress™ program?

Yes, absolutely. If you are an individual buyer (non 01 FFL holder) then you must undergo a background check and satisfy all regulatory requirements in your locality for interstate/intrastate firearm transfers. Warning! Buyer Beware - If you fail to pass the required background check or other requirements to lawfully complete the transfer of the gun to you, you will forfeit the gun. This means you will not get a refund, and you do not get to keep the gun. This is an absolute rule and federal law. The FFL retailer will make no exceptions. If you try to get someone else to receive the transfer in your place, this is against the law and the FFL retailer must notify federal authorities. If you are not 100% sure that you can pass the background check and other requirements, please do you use GunsExpress to purchase guns.

I couldn't pass the background check, do I get a refund or some credit?

No. Buyer beware! I you fail the background check, you LOSE your gun. There are NO refunds, credits, or adjustments. The gun becomes forfeited. All buyers must pass a background check and comply with all regulatory requirements in their locality to complete a proper transfer. Buyer, please be 100% sure that you can pass a background check before buying with GunsExpress.

How do I get the sales?

Once you are a registered FFL retailer in the GunsExpress program you are automatically included to receive sales generated by GunsExpress™ consumers in your locality. Here are the following ways you may receive sales:

  1. Generally, sale assignments are determined by your proximity to the customer. Sale assignments are presented to the FFL retailer with the details of the sale by email or fax and you have up to 2 hours to accept or reject the sale by emailing or faxing your response to GunsExpress.
  2. You direct your existing customers to use GunsExpress™ to shop from our million dollar virtual inventory, and to choose you as their FFL retailer. If and when they make a purchase, you will be automatically notified, but they must request that you be their FFL retailer. Why would you want to do this? Simple - you get to sell guns that you have no inventory investment or risk and you receive 100% of the mark-up.

Do I have to accept all sales offered to me?

No, you always have the right to refuse a sale from the GunsExpress™ program. Guntopia only represents you for getting sales form the Internet. If for any reason you do not want to accept a sale, just let us know right away. You're the boss when it comes to running your business.

I don't have a computer can I still be part of GunsExpress™?

Yes, but it becomes more difficult and costly because our electronic automated systems can't be used, and a manual process must be used to complete the sale. A handling fee of $15.00 is added to cover the additional cost.

It's TRUE and REAL. How much is the sales commission to GunsExpress™?

The sales commission is only 3% of the sale price of the gun or $25, whichever is greater, paid to GunsExpress from the sale proceeds. There are no monthly membership fees, or add-on fees.

Who determines the mark-up percentage?

As your sales representative, GunsExpress™ will negotiate and set the price within the FFL retailers pricing guidelines. We will try to get the highest fair price to make it worthwhile for everyone in the deal. You have the final say in the deal, if the mark-up is too low, you can always refused the sale.

What is my Responsibility for the Safekeeping of the Firearm During Delivery?

If you' re using the virtual showroom inventory, the firearm will be shipped by the distributor with insurance. You are responsible for the firearm once delivery is accepted. This means if the gun gets stolen, lost, or broken you are responsible for replacing the firearm at your own expense.

Who is responsible for the firearm once it leaves my warehouse?

You are to ship the firearm with insurance and signature required. Once the FFL Retailer has accepted (signed) the firearm, the FFL Retailer is responsible. GunsExpress issues the Purchase Order and is ultimately responsible. GunsExpress will pursue recovery from the FFL retailer in the event of a problem.
